REGULATIONS OF THE MANUSCRIPTUM ONLINE STORE

§1 General provisions

  • These regulations specify the rules for using the manuscriptum.pl Online Store, placing orders for products available in the manuscriptum.eu Online Store, delivering ordered products to the Customer, paying the product sale price by the Customer, order delivery, Customer's right to cancel the order and withdraw from the contract and rules for submitting and examining complaints.

  • The online store manuscriptum.pl, operating at www.manuscriptum.eu is run by Manuscriptum sp.z o.o., registered by the District Court in Warsaw, XII Commercial Department under the number KRS 0000654355. Registered office / correspondence address: 37, Domaniewska St., 02-672 Warsaw, Poland.

  • The store sells goods via the Internet. The Store publishes information about goods and services at www.manuscriptum.pl and the Manuscriptum company profile on facebook.com.

  • The terms used in these regulations mean:

    Online Store - a store operating at http://www.manuscriptum.eu, where its users can buy products offered by Manuscriptum Ltd. via the Internet;

    Online Store Database - a database containing data on transactions and goods that are offered in the Online Store. The database also stores data about customers using the online store to fulfill their orders;

    Order processing time - time during which Manuscriptum Ltd. completes the order and sends it to be sent to the carrier carrying out the delivery method chosen by the Customer to the address indicated by the Customer;

    Business days - all days of the week from Monday to Friday, excluding public holidays;

    Customer - a natural person with full or limited legal capacity as well as a legal person or organizational unit without legal personality, who on the principles set out in these regulations registers or registers in the Online Store;

    Cart - an element of the Online Store by means of which the Customer specifies the order details such as: the number of products, delivery address, invoice data, delivery method, payment method, etc .;

    Order fulfillment - delivery of ordered products to the Customer;

    Product page - a page in the Online Store on which information about the product is presented;

    Seller - Manuscriptum Ltd.

  • To use the manuscriptum.eu Online Store, including browsing the manuscriptum.pl Online Store range and placing orders for products, you need:

    a computer with access to the Internet and Internet browsers such as Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari;

    an active e-mail account.

  • The Customer is entitled and obliged to use the manuscriptum.pl Online Store for its intended purpose.

  • The Customer is obliged to refrain from any activity that could affect the proper functioning of the manuscriptum.pl Online Store, including in particular any interference with the content of the manuscriptum.pl Online Store or its technical elements, including providing content unlawful.

  • It is forbidden to use the manuscriptum.pl Online Store for purposes other than its intended purpose, including in particular sending spam, running on the website of the manuscriptum.pl Online Store any commercial, advertising, promotional activity etc. without the prior consent of Manuscriptum Ltd.

  • Manuscriptum Ltd. reserves the right to send the Newsletter to people who have subscribed to receive the Newsletter in the Online Store.

§ 2 Placing orders

  • Orders in the manuscriptum.pl Online Store can be placed 24 hours a day, 7 days a week.

  • The customer places an order by indicating the product he is interested in on manuscriptum.eu and launching the "Add to basket" link. Next, the customer indicates the method of collection and payment for the order. In order to place an order, the Customer is obliged to make:

    selection of ordered goods or services and their possible specification

    the choice of delivery method and delivery address,

    choose the payment method.

  • In the event of unavailability of the goods covered by the order and the inability to complete the order, the online store manuscriptum.eu will notify the customer. The customer will be able to change or cancel the order.

§ 3 Forms of payment and delivery

  • The price on the manuscriptum.pl Online Store website included with the offered product includes VAT and is given in Polish zlotys (PLN) It also includes shipping costs, as all products are shipped for free (in exceptional cases, the product may have a different indication)

  • The offer and product prices are valid while stocks last.

  • The customer can choose the following payment methods:

    ordinary bank transfer to Manuscriptum account,

    payment via the intermediary of PayU Internet payments,

    payment by a bank loan granted by a relevant bank in the PayU system, granted online on the principles set out in the PayU regulations and the banking regulations;

    payment on delivery on delivery of the goods (courier, postman or in a branch of Poczta Polska - depending on the delivery method and the ordered product).

  • If the Seller's bank account has not been credited with the amount due within 3 days from the date of order confirmation, the contract concluded between the Customer and the Seller shall be terminated and the order will be canceled.

  • The order from manuscriptum.pl is carried out by courier or Poczta Polska. It is also possible to collect the order personally after having contacted the manuscriptum.pl Store. Foreign shipments are carried out via Poczta Polska or after prior contact and approval by the Seller by courier.

§ 4 Order processing

  • Orders are processed from Monday to Friday from 10:00 to 16:00.

  • After placing the order, the service of the manuscriptum.eu online store will contact the Customer to provide information on the time of the order.

  • The domestic order is processed within 3 business days of placing the order. manuscriptum.eu reserves the right to process the order within more than 3 business days, of which the Customer will be notified.

  • The foreign order is processed within 2 to 14 business days.

§ 5 Right to withdraw from the contract

  • The customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.

  • In the event of withdrawal from a distance contract, the contract is considered null and void

  • The deadline to withdraw from the Sales Agreement expires after 14 days from the day on which the Customer came into possession of the Goods or from the date of receipt by the Customer of the last part of the completed order - if the order is carried out in parts.

  • To meet the deadline, it is enough to notify the Seller in oral, written or otherwise selected by the Customer about submitting a statement of withdrawal before the time until its submission.

  • The Customer may use the model withdrawal form provided by the Seller and send it via e-mail or in writing to the Seller's address, but it is not mandatory.

  • If the Customer uses the option to inform the Seller about withdrawal from the Sales Agreement via e-mail or other form of electronic communication, the Seller will immediately send the Customer confirmation of receipt of information on withdrawal from the Sales Agreement on a durable medium (for example, via e-mail).

  • Not later than within 14 days from the date of submission of the statement of withdrawal from the contract or together with this statement, the Customer shall deliver or send to the Online Store address manuscriptum.pl the purchased goods unchanged, unless a change was necessary in the ordinary management.

  • The Customer, by virtue of exercising his right to withdraw from the contract, shall not bear any costs other than the direct costs of returning the goods back to the Online Store.

  • If the goods returned by the Customer are incomplete, or bear traces of use, going beyond the ordinary management of the thing, the Seller, by making a refund, may reduce the refunded amount to the Customer by the total amount of the reduction in the value of the goods or the cost of repair incurred by him.

  • The Seller shall immediately refund the payment using the same payment methods that were used by the Customer in the original transaction, unless the Customer expressly agreed to a different solution; in any case, the Customer will not incur any fees in connection with the return.

  • Within 14 days from the date of receipt by the Seller of the Customer's statement of withdrawal from the contract, the Seller is obliged to return to the Customer all payments made by him, including the costs of delivery. The above does not apply to the cost of returning the goods back to the Store

  • If the Seller has not offered to collect the Customer's goods himself, he may withhold the reimbursement of payments received from the Customer until receipt of the item back or delivery by the Customer of a proof of return, depending on which event occurs first.

  • The right to withdraw from the contract is not entitled if the Seller provides:

    non-prefabricated items, manufactured according to the specification presented by the Customer or serving to satisfy his individual needs;

    in which the subject of the service is an item delivered in a sealed package,

    which cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery;

    in which the subject of the service are things that after delivery, due to their nature, are inseparably connected with other things;

    in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline to withdraw from the contract.

  • Online Store manuscriptum.eu is not responsible for failure to pay or delay the return date, if the Customer does not indicate the bank account number to which the payment is to be made or if he does not provide all the data necessary to make the payment. The online store manuscriptum.eu is not responsible for failure to pay or delay, if this was due to the Customer's providing incorrect personal data or an incorrect account number.

§ 6 Complaints

  • Complaints should be submitted to the address provided on the manuscriptum.eu Online Store website

  •  When submitting a complaint, please provide Manuscriptum Ltd. advertised product with proof of purchase and justification for the reason for complaint.

  •  Manuscriptum Ltd. will consider the complaint within 14 days from the date of delivery of the complained product.

  • If the complaint is considered in favor of the Manuscriptum Ltd. will repair or replace the advertised product for a new, full-fledged one or return the value of the purchased product.

§ 7 Final provisions

  • The goods presented on the manuscriptum.eu Online Store website do not constitute an offer within the meaning of the Civil Code. Information about the goods posted on the pages does not mean that the goods are available in the Store's warehouse or from its suppliers.

  • The online store manuscriptum.pl is not responsible for the blocking by mail server administrators of sending messages to the e-mail address provided by the Customer, and for the removal and blocking of e-mail messages by software installed on the computer used by the Customer.

  • The online store manuscriptum.eu shall not be liable for errors in handling the order or other instructions of the Customer, resulting from the Customer providing incorrect data.

  • In matters not covered in these regulations, the provisions of generally applicable law shall apply, in particular the Civil Code and the Act on special conditions of consumer sales.

  • Goods offered on manuscriptum.eu, their names and trademarks are the exclusive property of their producer and are protected by law.

  • In accordance with applicable law, we inform that the owner of the store is a producer (marketing to the territory of Poland) of the products he sells or their distributor.

  • Any use of photos, copying the page in whole or its parts without the written consent of the manuscriptum.pl store owner is prohibited and may have appropriate legal consequences.

  • The online store manuscriptum.eu reserves the right to change the Regulations. Any changes to the Regulations come into force on the date indicated by the manuscriptum.eu Online Store, not less than 7 days from the date they are available on the manuscriptum.pl Online Store website. Orders placed before the date of entry into force of amendments to these Regulations are implemented on the basis of the provisions in force on the date of the order.

  • Any disputes arising in connection with the transaction in the Online Store will be settled by the parties by agreement. In the event of disagreement, disputes will be submitted to a court having jurisdiction in accordance with the Code of Civil Procedure

  • These Regulations apply from 12-03-2018.

§8 Protection of privacy

  • The administrator of personal data is the Seller

  • By placing an Order, the Customer agrees to the processing of his personal data solely for the purpose of delivery and execution of the Order.

  • The rules for the protection of personal data in connection with the provision of electronic services along with the policy of storing IT data that are processed for the purpose of transmitting messages in the electronic communications network or calculating fees for these services are set out in the Privacy Policy, available on the Store's website.

  • The Customer may, during Registration, voluntarily consent to the processing of his personal data for marketing purposes by checking the appropriate box on the registration form. In this case, the Seller clearly informs about the purpose of collecting personal data, as well as about known or anticipated recipients of such data. Expressing consent means, in particular, consent to receive commercial information to the User's or Buyer's e-mail address provided in the registration form.

  • The customer has the right to access their personal data, correct them, request to stop processing them, object to their processing and delete them.

  • Consent to data processing may be withdrawn at any time by submitting an appropriate statement to the Seller on a durable medium. For example, the statement may be sent to the Seller's address via e-mail.

  • The store, with the prior consent of the customer, user or their representative, stores on their computer cookies that are necessary: ​​to conclude a distance sales contract, perform it and provide the "My Account" service, and to facilitate the User and Customer using the Store's website by maintaining the session (which makes it unnecessary to re-enter the password) and creating subpage view statistics.

  • Files entered by the Store on the computer of the Customer, User or their representative do not collect their personal data, do not affect the configuration of the operating system or software and can be deleted at any time.

  • The Service Recipient may at any time delete placed cookies or block the placement of cookies using the options available in his web browser.
